What should I expect?

I have a no contact order against my ex and we share custody of our 14 year old son. Yesterday his dad took the cell phone i gave our son for emergencies out of vindictiveness. I have insurance to replace it but it's still $60. The cell companys said I needed a police report in order to waive to the fee. I ended up getting a police report and the officer said they are going to charge his dad with theft. Will his dad go to jail or fined for stealing my property? I'm kind of nervous because my ex gets violent when i involve the police. Any advice is helpful
